Long Branch New Jersey Marijuana Possession and Distribution Lawyer
One of the charges our criminal defense lawyers typically encounter is marijuana possession and/or marijuana distribution in Long Branch, NJ. Now, it is important to understand the difference between simple possession charges, which may be handled by the Long Branch Municipal Court, and distribution of marijuana charges which will be handled by the Monmouth County Superior Court in Freehold.
With regard to possession of marijuana charges in New Jersey, if the amount of marijuana allegedly in your possession is 50 grams or more, this is considered fourth degree possession of marijuana and must be handled at the county level in Freehold. However, if the amount of marijuana allegedly in your possession is 50 grams or less, this is a disorderly persons offense and can be handled at the Long Branch Municipal Court. Remember, a conditional discharge may be available as a probationary program for your minor marijuana offenses at the Municipal Court level in New Jersey.
On the other hand, charges for marijuana distribution must be handled at the Superior Court level, which in the case of Long Branch, is the Monmouth County Superior Court. In terms of grading for a marijuana distribution charge, if you are allegedly in possession of 25 pounds or more of marijuana, this is a first degree offense in NJ.
