Middlesex County New Jersey Indictable Criminal Charges
The Iler Law firm frequently represents clients in Middlesex County Superior Court. For example, our firm represented an individual charged with one count of third degree possession of a controlled dangerous substance (CDS) and one count of third degree distribution of CDS for allegedly selling oxycodone pills. After reviewing discovery, our criminal defense lawyers determined that the State had a strong case against the defendant as there were no search and/or warrant issues related to the drugs. Further, the State had the testimony of an officer who allegedly observed one of the drug sales.
As a result, it was essential that we obtain the best possible plea deal for our client. However, our client had one prior indictable criminal offense on his record for distribution of CDS. Thus, he was subject to the Brimage sentencing guidelines which means a mandatory term of imprisonment and parole ineligibility. As a result, our client was not eligible for Pre-Trial Intervention (PTI) because of this prior indictable conviction. Further, our client was facing significant jail time as a result of this second drug distribution offense. However, we applied to Drug Court on behalf of our client and he was accepted into the Middlesex County Drug Court program. Thus, he will have an intense 5-year probationary period for Drug Court which includes drug testing and counseling and will avoid a mandatory jail sentence. This was a great result for our client and is also beneficial to the State as the Drug Court programs in Middlesex County and Monmouth County are extremely successful in rehabilitating non-violent drug offenders.
