Suspension of Your New Jersey Driver's License
There are many reasons for a suspension of your driver's license in New Jersey. Protecting Your Rights: Due Process and License Suspension
In New Jersey, courts have consistently held that a driver's license may not be suspended or revoked without procedural due process. State v. Wenof, 102 N.J. Super 370 (Law Div. 1968). In fact, the New Jersey legislature saw fit to codify these protections in N.J.S.A. 39:5-30 which states, "[e]very registration certificate, every license certificate, every privilege to drive motor vehicles...may be suspended or revoked by the director for a violation of the provisions of this Title or on any other reasonable grounds, after due notice in writing of such proposed suspension, revocation, disqualification, or prohibition or ground thereof." N.J.S.A. 39:5-30. Further, the New Jersey Supreme Court held that a driver's license may not be taken away without due process and the licensee must be fully informed of the charges against him and must be afforded a fair opportunity to be heard.
